Welcome to Luno AI ("App"), developed and operated by InnoWave SRL ("Company", "we", "us", or "our"). By downloading, installing, or using the App, you agree to these Terms of Service and Apple's Standard End User License Agreement (EULA).

1. Apple Standard EULA

This App is licensed to you under Apple's Standard End User License Agreement (EULA), available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. By using this App, you acknowledge that you have read, understood, and agree to be bound by Apple's Standard EULA. In case of any conflict between these Terms and Apple's EULA, Apple's EULA shall prevail for matters related to the App Store distribution.

2. Description of Service

Luno AI is an AI-powered habit coaching platform that helps users build and maintain healthy habits, track nutrition, set goals, and receive personalized coaching. The Service includes mobile applications for iOS and Android, web interfaces, and associated features.

3. Subscriptions & In-App Purchases

Luno AI offers premium features through auto-renewable subscriptions. Subscription options include Weekly ($2.29/week), Monthly ($6.99/month), and Yearly ($49.99/year) plans. Payment will be charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel your subscriptions by going to your App Store account settings after purchase.

4. Free Trials

We may offer free trial periods for premium subscriptions. If you do not cancel before the trial ends, you will be automatically charged the subscription fee. Any unused portion of a free trial period will be forfeited when you purchase a subscription.

5. Refunds

All purchases are processed through the Apple App Store. Refund requests must be submitted directly to Apple according to their refund policy. We do not have the ability to process refunds for App Store purchases. Visit https://support.apple.com/en-us/HT204084 for Apple's refund process.

The App provides general wellness information and habit coaching for informational and motivational purposes only. Never disregard professional medical advice or delay seeking treatment because of information provided by this App.

7. User Accounts

To use certain features of the App, you must create an account. You agree to provide accurate information and keep it updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must be at least 13 years old to create an account.

8. Intellectual Property

The App and its original content, features, and functionality are owned by InnoWave SRL and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our express written permission.

9. Termination

We may terminate or suspend your account and access to the App at any time for violation of these Terms. You may delete your account at any time through the app settings. Upon termination, your right to use the App will cease, but your subscription obligations to Apple remain in effect until cancelled.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, INNOWAVE SRL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP. Our total liability shall not exceed the amount you paid for the App in the twelve months preceding the claim.

11. Governing Law

These Terms shall be governed by the laws of Romania. Any disputes shall be resolved in the courts of Romania, except where Apple's EULA specifies otherwise.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes through the App or via email. Continued use after changes constitutes acceptance of the updated Terms.
